Land Use & Municipal Law

Mr. Nosky represents both private and public clients and focuses on all aspects of municipal law and land use.  With over 25 years of background in working with public agencies, most recently as the City Attorney of Santa Clara, he has extensive experience advising clients in land use, zoning and planning, environmental law, real property entitlements, development agreements, affordable housing, FPPC matters, election law and voting rights. He currently serves as the Interim City Attorney of Los Altos. For private clients, he is involved with all aspects of the land development process, including developing strategies to ensure the legal adequacy of the planning documents and EIRs, participating in the administrative process, assisting in development infrastructure plans and financing, and negotiating settlements of contentious development related disputes.

Representative Matters

  • Served previously as City Attorney for the cities of Santa Clara, Stockton and Salinas. Also served as general counsel to numerous public agencies, including the Santa Clara Stadium Authority, Zone 7 Water Agency, Monterey County Water Resources Agency, Transportation Agency for Monterey County and several redevelopment agencies.
  • Represented City of Santa Clara with respect to all issues regarding the financing, construction and management of Levi’s Stadium. Have also advised public clients on the development of two other professional sports venues.
  • Advised the City of Santa Clara in the negotiation of ground leases and entitlements for an 8 million square foot, multi-phase, mixed-use project to be developed by a private developer on land owned by the City adjacent to Levi's Stadium.
  • Negotiated and drafted numerous development agreements for large scale commercial and residential developments.
  • Handled legal issues and worked closely with the National Football League and Host Committee concerning the negotiation, preparation and implementation of Super Bowl 50.
  • Negotiated landmark settlement agreement on behalf of the City of Stockton with the California Attorney General (now Governor) Jerry Brown regarding the city’s general plan.
