Associate Attorney, Estate Planning

Merced

Berliner Cohen, LLP, seeks an experienced Attorney with an interest in or experience in estate planning, estate administration and probate, research, income and estate taxation, and trust administration for its Merced office.

The ideal candidate will have a minimum of 3 years of experience. Newer attorneys with exceptional academic credentials will also be considered.

Attorneys with less than three years of experience are requested to provide unofficial law school transcripts and writing samples (a maximum of three pages).

The successful candidate will have strong local ties, a desire to live and work in the Merced area, a strong academic background, a proven track record of strong performance, and measurable results with exceptional communication, analytical, and writing skills.

An Estate Planning Attorney in Merced with at least three years of experience can reasonably expect to start at $125,000; however, actual compensation will depend on various factors, including, without limitation, the candidate's qualifications and experience.

Attorney, Employment Law Department

San Jose

Berliner Cohen’s San Jose Employment Department is seeking an Associate Attorney with 3 + years of labor law and employment litigation experience.

The ideal applicant desires to be a zealous advocate, has counseled clients and litigated wage and hour cases, class action cases, and employment discrimination and wrongful termination matters in California. Familiarity with administrative charges, and be familiar with wage laws, leave and compliance matters (FMLA, ADA, wage and hour), policy development, compliance training, and managing pre-litigation disputes.

The successful candidate will possess a strong academic background, a proven track record of strong performance and measurable results, and exceptional communication, analytical, and writing skills. The candidate must also be a current member of the State Bar of California and in good standing.

An employment attorney with at least three years of experience can reasonably expect to start at $160,000; however, actual compensation will depend on various factors, including, without limitation, the candidate's qualifications and experience.

Depending on the candidate's location, we would consider candidates wanting to work in both our San Jose and Modesto offices. Applicants must be willing to travel to client sites, work in multiple counties, and travel between firm offices.

Attorney, Employment Law Department

Modesto

Berliner Cohen is seeking an experienced employment law attorney with 5+ years of experience to join the growing Employment Law practice.

The ideal applicant will have counseled clients and litigated wage and hour cases, class action cases, as well as employment discrimination and wrongful termination matters in California state and federal courts, responded to administrative charges, and be familiar with wage laws, leave and compliance matters (FMLA, ADA, wage and hour), policy development, compliance training and managing pre-litigation disputes.

Applicant must have experience with preparing responsive pleadings, engaging in motion practice, responding to discovery as well as counseling clients on employment law.

Applicant must be willing to travel to client sites, work in multiple counties and travel between firm offices.

The successful candidate will possess a strong academic background, a proven track record of strong performance and measurable results with exceptional communication, analytical, and writing skills.

The Employment Attorney with 5+ years’ salary range is dependent on experience and areas of expertise $145,000 to $200,000. The successful candidate's salary for this position is reasonably expected to be set within this range; however, actual compensation will depend on a variety of factors, including, without limitation, the candidate's qualifications and experience.

Litigation Associate Attorney

San Jose

The Litigation department at Berliner Cohen is actively recruiting for an Associate Attorney with 3 + years of litigation experience with interest in business, commercial, trust & estate, and real estate.

Litigation Associate

Merced

Our Merced office is actively recruiting for an Associate Attorney to work in our litigation practice and candidates should have an interest in business, commercial, trust & estate, and real estate litigation. We will consider applicants with experience ranging from new admittees to 5 years of experience.

Requirements: The successful candidate will possess a strong academic background, a proven track record of strong performance and measurable results with exceptional communication, analytical, and writing skills. The ability to be a creative thinker and problem solver and to work independently and with a team is also required.

Candidates must have a J.D. from an accredited law school and current good standing with the California State Bar. Candidates must have ties to the Merced area.

The salary range for this position in our Merced office is $107,500 to $150,000. The successful candidate's salary for this position is reasonably expected to be set within this range; however, actual compensation will depend on a variety of factors, including, without limitation, the candidate's qualifications, and experience.

Senior Attorney Employment Department

San Jose

Berliner Cohen has immediate openings in our Employment Department for a Senior Attorney with a minimum of 5+ years of labor law and employment litigation experience. No book of business is required, but it is beneficial. The position would be for Senior Attorney or Of Counsel, depending on experience and background. This position may be in our San Jose or Modesto Office.

The ideal applicants will be able to work independently and manage a case from beginning to end with little direction and oversight. They must have taken depositions, handled hearings, and been lead counsel on a case. In addition they will have counseled clients on all aspects of wage and hour laws, as well as, litigated wage and hour cases, class action cases, as well as employment discrimination and wrongful termination matters in California state and federal courts, responded to administrative charges, and be familiar with wage laws, leave, and compliance matters (FMLA, CFRA, ADA, FLSA and Ca Labor Codes), policy development, compliance training and managing pre-litigation disputes.

The successful candidate will also possess a strong academic background, a proven track record of strong performance, and measurable results with exceptional communication, analytical, and writing skills.

Hybrid work will be considered for the right candidate. All candidates must be able to appear in court, travel for depositions, and related litigation appearances.

The salary range starts at $210,000. The actual compensation will depend on various factors, including, without limitation, the candidate's qualifications and experience.

Administrative

Calendar Clerk

San Jose

Berliner Cohen LLP, a mid-sized law firm in downtown San Jose, has an immediate opening for a Calendar Clerk.

Requirements include: a minimum of three (3) years of administrative experience. Must have a professional appearance and demeanor with excellent written and verbal communication skills. Candidates should have top-notch organization skills, attention to detail, proficiency with Microsoft Word applications, word processing, cloud-based databases, spreadsheets, time management, analytical skills, and the ability to prioritize.

Preferred Experience: Someone with experience working in a law firm as a calendar clerk (docketing) or litigation secretary. Familiarity with California Superior Court and District Court Dockets rules/procedures. Plus, experience with CompuLaw or Milana.

Core Competencies: teamwork, planning, organization, adaptability, problem solving, and initiative.

This is a full-time position in the office, Monday through Friday, 8:00 am to 5:00 pm.

Calendar Clerk Duties

  • Ability to review and read pleadings (court documents) and discovery to capture deadlines.

  • Other duties assigned related to the position

Employment Litigation Paralegal

San Jose

Berliner Cohen, LLP is seeking an experienced Employment Litigation Paralegal to work alongside a team of diverse professionals while assisting attorneys in handling all aspects of litigation. The qualified candidate will assist attorneys in managing personnel actions, advice and counsel, class actions, management of evidence, answering interrogatories, and preparing motions, complaints, briefs, and other legal documents; interviewing clients and witnesses for hearings, deposition, and trial; be familiar with e-discovery and coordinating with outside vendors and contractors to perform discovery obligations, be versed in excel and data creation and perform all types of legal support work assigned as permitted by the rules of the California State Bar.

Candidates should possess a strong academic background, a proven track record of strong performance and measurable results, and exceptional communication, analytical, and writing skills. They must also be able to be creative thinkers and problem solvers and work independently and with a team. All candidates should have a strong background in Excel.

Education Requirements: Must possess a Paralegal certificate or a degree in paralegal studies.

Preferred: Bachelor's degree and a Paralegal Certificate from an American Bar Association (ABA) approved program.

Experience Requirements: Minimum of five years' experience working as a paralegal inhouse, working in human resources for a company, and a civil litigation law firm. Must have experience in ESI Discovery and be Proficient in Excel.

Skills: Ability to work independently, see tasks through fruition, excellent attention to detail, and familiarity with electronic discovery platforms and Excel databases.

This position is not hybrid or remote. The candidate must be willing to work out of our San Jose office.
