THE PROGRAM:
Warrants and subpoenas are not limited to use in criminal investigations.  State and Federal government agencies have the ability to review and copy records, inspect your premises, or interview your employees to investigate violations of laws relating to trade secrets, workplace safety, immigration, payment of wages, and toxic disposal.  The interests of the business owner in avoiding even the appearance of illegal conduct and minimizing disruption of its operations may conflict sharply with the Constitutional rights of individual employees.

Addressing these conflicting interests is essential through up-to-date policies and practices that deal with electronic and paper records, reporting and disclosure responsibilities, as well as training managers about what to do (or not do) if a warrant or subpoena is served.

Berliner Cohen’s employment law and litigation attorneys will discuss the keys to effective policies and preparation for government investigation.  Topics include:

Christian Picone and Kate Wilson, Berliner Cohen attorneys

Christian Picone is a litigator in the Berliner Cohen business litigation group where he represents individuals and businesses in both civil and criminal litigation at the state and federal levels.  His criminal practice emphasizes white collar criminal defense in the areas of theft of trade secrets, securities violations, embezzlement and fraud.  Prior to joining Berliner Cohen, Mr. Picone worked as a lead felony prosecutor in Illinois, specializing in white collar crime.  Mr. Picone has conducted over thirty jury trials to verdict.
